GENERAL TERMS OF SERVICE
(MASTER TERMS OF SERVICE)

Welcome to Zyn Data technology ecosystem.
This document is the Master Agreement defining legal rights and obligations between ZYN DATA TECHNOLOGY SOLUTIONS CO., LTD. (hereinafter referred to as "Zyn Data", "We", "Party A") and Individual, Organization or Enterprise using the service (hereinafter referred to as "Customer", "User", "Party B").
This agreement applies uniformly to all brands and services under Zyn Data, including but not limited to: Zynhost, Zynshield, and other future services.
By registering and using services of any brand under Zyn Data, Customer automatically agrees to comply with:
- This General Terms.
- Service Specific Terms of each specific brand that Customer uses.
ILEGAL REGULATIONS AND CONDUCT
Article 1. Compliance with Law and Purpose of Use
Customer commits to using the service only for lawful purposes. Zyn Data strictly prohibits and will unilaterally terminate the contract immediately without refund for the following acts:
- Anti-State Activities: Storing, disseminating reactionary content, opposing the Socialist Republic of Vietnam, violating national security.
- Prohibited Content: Storing, distributing obscene materials, pornography, social evils, gambling, illegal betting.
- Cybercrime: Performing cyber attacks (DDoS, Botnet), distributing malicious code (Virus, Malware, Ransomware), phishing, unauthorized scanning originating from Zyn Data infrastructure.
- IP Violation: Storing, distributing pirated software (crack), copyrighted content without author's permission.
Article 2. Account Security and Identification (KYC)
- 1. Registration Information: Customer is obliged to provide accurate, complete and updated information (Email, Phone Number, Full Name). Zyn Data reserves the right to request identity verification (KYC) with ID card/Passport when detecting unusual signs or account disputes.
- 2. Security: Customer is fully responsible for securing login information (Username, Password, SSH Key). Zyn Data is exempt from liability for any damages arising from Customer disclosing access information to third parties.
- 3. "One Account" Policy: Strictly prohibit creating multiple accounts (clones) to exploit promotions. Zyn Data reserves the right to permanently lock violating accounts.
IIPAYMENT AND FINANCE
Article 3. Payment Regulations
- 1. Term: Service operates on a Prepaid model. Customer needs to pay 100% of the cost before the service is activated or renewed.
- 2. Method: Accept bank transfer, e-wallet, online payment gateway or scratch card (according to current card fee policy).
- 3. Tax: Listed prices on the website may not include VAT. Enterprise Customers requiring financial invoices please contact accounting department and pay an additional 10% VAT.
Article 4. Late Payment Handling and Renewal
- 1. Suspend: Service will be automatically suspended if not paid within 01-03 days from the expiration date.
- 2. Terminate: If payment is overdue from 03-07 days (depending on specific service), the system will automatically cancel the service and permanently delete data to free up resources. Zyn Data is not responsible for data lost due to late payment.
Article 5. General Refund Policy
- 1. Principle: Zyn Data is committed to refunding to ensure customer rights, however this policy only applies to the first order of new Customers for experience purposes.
- 2. Golden Time: 100% service fee refund within first 03 days if error originates from provider or service is not as committed.
- 3. After Golden Time: Refund will be charged administrative fee and deducted number of days used. (Details of fees are specified at payment page or Specific Terms of each service).
- 4. Exceptions: No refund for: Domain Names, Software Licenses, Dedicated Servers, or Customers violating Terms of Use.
IIIDATA AND TECHNICAL RESPONSIBILITY
Article 6. Ownership and Data Backup
- 1. Ownership: Data stored on the server belongs to the ownership and legal responsibility of the Customer. Zyn Data does not intervene in customer data unless requested by authorities.
- 2. Backup Responsibility (IMPORTANT): Although Zyn Data has system redundancy mechanisms (RAID), Customer is required to proactively backup data periodically to personal computer or secondary storage.
- 3. Data Liability Exemption: Zyn Data is not responsible for compensating data in cases: Force majeure hardware failure, natural disasters, Customer's accidental deletion, or service cancelled due to violation/expiration.
Article 7. Service Level Agreement (SLA) and Support
- 1. Uptime: Committed to maintaining system uptime at 99% monthly (excluding notified periodic maintenance).
- 2. Support Channels: Zyn Data officially supports via Ticket system, Email and Hotline. Social Media channels are for initial information reception only.
- 3. Support Limits: Zyn Data supports issues related to infrastructure, network and hardware. Support for installing 3rd party software, web code configuration, intensive game server will depend on policy of each service package.
Article 8. Fair Use Policy
Customer shares infrastructure with other users, therefore strictly prohibit resource appropriation acts affecting the general system:
- 1. Hardware Abuse: Running tasks that "exhaust" CPU/RAM/Disk I/O continuously (such as crypto mining, heavy graphic rendering on regular Hosting/VPS packages).
- 2. Network Abuse: Using Zyn Data infrastructure as public Proxy/VPN, trading illegal Anti-DDoS services (when not using dedicated Reseller package), or as target to attract DDoS attacks for outside.
IVENFORCEMENT TERMS
Article 9. Force Majeure
Zyn Data is exempt from liability for performing obligations in cases beyond reasonable control, including but not limited to: Natural disasters, fires, wars, epidemics, widespread submarine cable incidents, or prohibition/restriction decisions from State agencies.
Article 10. Dispute Resolution
All disputes arising will be prioritized for resolution through negotiation and mediation in a cooperative spirit. If no agreement is reached, the dispute will be brought to the competent People's Court in Dong Nai Province. The Court's decision is final.
Article 11. Terms Amendment
Zyn Data reserves the right to amend or supplement the content of this Agreement at any time to comply with legal regulations and business situation. The amended content will take effect immediately upon being publicly updated on Zyn Data's website system and subsidiary brands. Customer's continued use of service after terms are updated implies acceptance of those changes.
